Terms of Service for Hydrate

Changes in this version

We've rewritten these terms to be shorter and easier to understand. In summary:

  • Reorganised from 16 sections into 12 and simplified the wording throughout - what you agree to hasn't changed
  • Governing law is now Queensland, Australia; consumer protections where you live still apply
  • Clarified that ban and termination decisions don't affect your rights under the Australian Consumer Law
  • The indemnity for user-submitted content now only covers claims caused by breaking the content rules
  • Updated the CFX.re platform licence link to the January 2026 agreement

1. Definitions

  • Server: Hydrate's roleplay game server.
  • Services: Any and all aspects of Hydrate, including but not limited to the Server, supporting infrastructure, management tools, communication platforms (e.g., Discord), the website and store, and any other systems or tools used to facilitate the operation, management, or communication of the Hydrate experience.
  • User: Any individual accessing or interacting with the Server or Services.
  • Community Guidelines: The rules and standards that all Users must follow to ensure a positive and fair roleplaying experience, covering acceptable behaviour, in-game interactions, and content submission. The Community Guidelines are located here and are subject to change at any time.
  • User-Submitted Content: Any content submitted by a User to Hydrate, such as code, 3D assets, images, videos, or other media.
  • Supporter Packages: Voluntary contributions made by Users that may provide in-game bonuses. These packages hold no monetary value and are not linked to guaranteed in-game access or privileges.
  • Tebex: A third-party payment processor facilitating transactions for Supporter Packages.
  • Staff: Administrators and moderators responsible for the management of the Server and Services.
  • Privacy Policy: The document outlining how Hydrate collects, uses, stores, and protects Users' personal data, including system-level and device information used for identifying and securing user sessions. The Privacy Policy is located here and is incorporated by reference into these Terms of Service; by using the Services, you agree to both.

2. No Guarantee of Service; Disclaimer of Warranties

Hydrate offers access to the Server and Services as-is and as-available, without warranties of any kind, express or implied - including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Server will be available at all times or without interruption, and we reserve the right to modify, suspend, or discontinue any part of the Services at any time.

To the maximum extent permitted by law, Hydrate disclaims liability for any loss, damage, or harm - including indirect, incidental, or consequential damages - arising from the availability, performance, or use of the Server or Services. Your use of the Services is at your own risk. This section is subject to section 10 (Consumer Law).

3. Community Guidelines and Termination of Access

By accessing the Server, you agree to abide by the Community Guidelines. We reserve the right to restrict, deny, or terminate your access to the Services at any time - including for failure to comply with the Community Guidelines - as determined by Staff, whose decisions on bans and terminations are final.

There is no automatic right of appeal. Hydrate may review access restrictions or bans on a discretionary, case-by-case basis - where it does, the review follows the Ban Appeals process - but this does not create an obligation or guarantee of appeal.

Nothing in this section limits any rights or remedies you may have under section 10 (Consumer Law).

4. Supporter Packages

All Supporter Packages are voluntary contributions to support the Hydrate community. Any in-game bonuses or perks provided as part of these packages have no monetary value, are subject to change, and may be removed at any time.

No refunds are provided under normal circumstances, including if access to the Server is revoked or denied, except as required under the Australian Consumer Law. If Hydrate fails to provide services in accordance with the Australian Consumer Law, you may be entitled to a refund or other remedy. Please contact us via the Hydrate Discord for any concerns related to refunds or service issues.

5. Payments via Tebex

All transactions for Supporter Packages are processed through Tebex, a third-party payment processor. By completing a purchase, you agree to the Tebex Terms of Service, which are available at checkout, including as Tebex may update them. Hydrate does not store payment information or handle the transaction process directly.

Disputes related to payment processing, refunds, or charges must be resolved directly with Tebex, unless the issue specifically concerns in-game content or services provided directly by Hydrate. To the maximum extent permitted by law, Hydrate is not responsible for payment processing errors or other issues caused by third-party providers such as Tebex.

6. Third-Party Platforms and Policies

Your use of the platforms involved in accessing the Services is also governed by third-party terms and policies, including:

  • CFX.re: The CFX.re Platform Licence Agreement applies to your use of the platform on which the Server operates.
  • Rockstar Games: Your interactions with Rockstar Games platforms, such as Grand Theft Auto V or Rockstar Social Club, are governed by their privacy policy.
  • Discord: Participation in our community may involve Discord, whose policies govern your use of their platform and data.

Please review these external policies, as they govern your rights and responsibilities on those platforms.

7. Monitoring and Logging

Hydrate monitors and logs activity within the Server and Services - including communications, gameplay actions, trades, interactions with other Users and in-game systems, and System Information - to enforce the Community Guidelines, prevent cheating, and protect the integrity of the platform. By using the Services, you consent to this monitoring and logging. How this data is used, protected, and retained is described in the Privacy Policy.

8. Legitimate Copy of Game Required

You must have a legitimate, legally purchased copy of Grand Theft Auto V to access and use the Server. Use of pirated or cracked copies of the game is strictly prohibited. Any User found using, or attempting to use, a non-legitimate copy of the game will have their access to the Server terminated immediately, without the right of appeal.

9. User-Submitted Content

By submitting User-Submitted Content to Hydrate, you retain ownership of your content, but you grant Hydrate a worldwide, non-exclusive, perpetual, royalty-free, sublicensable licence to use, modify, reproduce, distribute, display, and exploit that content solely for purposes related to the operation, promotion, or improvement of the Services.

You represent that you have the legal right to submit the content and that your submission does not infringe any third-party rights, including intellectual property rights. You are solely responsible for ensuring you have that right, and Hydrate will not be liable for claims related to the use of unauthorised or infringing content. In the event of any third-party claim relating to your submitted content, you agree to indemnify and hold Hydrate harmless from damages, costs, and liabilities, including reasonable legal fees, to the extent the claim arises from your breach of this section.

10. Consumer Law

Nothing in these Terms of Service is intended to limit or exclude any guarantees, warranties, rights, or remedies you may have under the Australian Consumer Law or any other applicable legislation that cannot lawfully be excluded. If any of these terms are found to contravene applicable law, those terms will be modified only to the extent necessary to comply, and all other terms remain in full effect.

11. Legal Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising from these terms or the use of the Services are subject to the non-exclusive jurisdiction of the courts of Queensland (nothing in this clause deprives a consumer of protections available in their place of residence).

12. Changes to the Terms of Service

Hydrate reserves the right to modify these Terms of Service at any time. Changes are effective upon being posted. It is your responsibility to periodically review these Terms of Service; continued use of the Services after updates constitutes acceptance of the changes. In the event of significant changes, we will notify Users via our official communication channels.

By accessing the Hydrate Server or Services, you agree to these Terms of Service, the Privacy Policy, and the applicable Community Guidelines. If you do not agree, please refrain from using the Services.
