Terms of Service for Hydrate​

1. Definitions​

  • Server: Refers to Hydrate's roleplay game server.
  • Services: Refers to any and all aspects of Hydrate Roleplay, including but not limited to the Server, supporting infrastructure, management tools, communication platforms (e.g., Discord), and any other systems or tools used to facilitate the operation, management, or communication of the Hydrate Roleplay experience.
  • User: Any individual accessing or interacting with the Hydrate Roleplay Server.
  • Community Guidelines: The rules and standards that all Users of Hydrate Roleplay must follow to ensure a positive and fair roleplaying experience. These guidelines cover acceptable behaviour, in-game interactions, and content submission. The Community Guidelines are located here and are subject to change at any time. Failure to comply with these Community Guidelines may result in removal or restriction of access to the Server.
  • User-Submitted Content: Any content submitted by a User to Hydrate Roleplay, such as code, 3D assets, images, videos, or other media. Users retain ownership of their submitted content but grant Hydrate Roleplay a licence to use it for any purpose related to the Server.
  • Supporter Packages: Voluntary contributions made by Users that may provide in-game bonuses. These packages hold no monetary value and are not linked to guaranteed in-game access or privileges.
  • Tebex: A third-party payment processor facilitating transactions for Supporter Packages.
  • Staff: Administrators and moderators responsible for the management of the Server.
  • Privacy Policy: The document outlining how Hydrate Roleplay collects, uses, stores, and protects Users' personal data, including system-level and device information used for identifying and securing user sessions. The Privacy Policy is incorporated by reference into these Terms of Service, and by using the Server, you agree to the terms outlined in both the Terms of Service and the Privacy Policy. 2. No Guarantee of Service​

Hydrate Roleplay offers access to the Server and its Services as-is and as-available, without any guarantees. We do not warrant that the Server will be available at all times or without interruption. We reserve the right to modify, suspend, or discontinue the Server at any time, for any reason, without notice. Hydrate Roleplay shall not be liable for any indirect, incidental, or consequential damages related to the availability, performance, or use of the Server or Services.

3. Agreement to Community Guidelines​

By accessing the Server, you agree to abide by the Hydrate Roleplay Community Guidelines. Failure to adhere to these Community Guidelines may result in the restriction or termination of access to the Server, as determined by Staff. Users removed from the Server for guideline violations have no automatic right of appeal. Hydrate Roleplay reserves the right to review access restrictions or bans on a discretionary basis, but this does not create an obligation or guarantee of appeal.

4. Termination of Access​

We reserve the right to deny or terminate your access to the Services at any time, for any reason, without notice or liability. Staff decisions on account bans or terminations are final and non-negotiable. While there is no inherent right to appeal, Hydrate Roleplay reserves the right to handle appeals on a case-by-case basis at its sole discretion.

5. Supporter Packages​

All Supporter Packages are considered voluntary contributions to support the Hydrate Roleplay community. Any in-game bonuses or perks provided as part of these packages have no monetary value, are subject to change, and may be removed at any time for any reason.

No refunds are provided under normal circumstances, including if access to the Server is revoked or denied, except as required under Australian Consumer Law. If Hydrate Roleplay fails to provide services in accordance with the Australian Consumer Law, you may be entitled to a refund or other remedy. We encourage you to contact us via the Hydrate Discord for any concerns related to refunds or service issues.

6. Payments via Tebex​

All transactions for Supporter Packages are processed through Tebex, a third-party payment processor. By completing a purchase, you agree to the Tebex Terms of Service, which are available at checkout. Hydrate Roleplay does not store any payment information or handle the transaction process directly.

Any disputes related to payment processing, refunds, or charges on Tebex must be resolved directly with Tebex, unless the issue specifically pertains to in-game content or services provided directly by Hydrate Roleplay.

Hydrate Roleplay is not responsible for payment processing errors or issues with third-party providers like Tebex. Hydrate Roleplay is not responsible for any changes to Tebex's terms of service or their operational policies, and you agree to be bound by any such changes imposed by Tebex.

7. Agreement with External Policies​

By accessing and using the Hydrate Roleplay Server and Services, you acknowledge that your data and interactions may also be subject to third-party policies, including:

  • CFX.re Terms of Service: The CFX.re Terms of Service apply to your use of the platform on which the Hydrate Roleplay Server operates.
  • Rockstar Games Privacy Policy: Your interactions with Rockstar Games platforms, such as Grand Theft Auto V or Rockstar Social Club, are governed by their privacy policy.
  • Discord: Participation in our community may involve the use of Discord, whose policies govern your use of their platform and data.

Please review these external policies, as they govern your rights and responsibilities when using platforms associated with the Hydrate Roleplay experience.

8. Monitoring and Logging​

Hydrate Roleplay monitors all in-game communications, interactions, and gameplay for the purposes of enforcing Community Guidelines, preventing cheating, and ensuring a fair roleplaying experience. By using the Services, you consent to having your activities monitored and logged. This includes but is not limited to actions such as communications, trade, and general interactions with the environment.

9. Legitimate Copy of Game Required​

You must have a legitimate, legally purchased copy of Grand Theft Auto V to access and use the Hydrate Roleplay Server. Use of pirated or cracked copies of the game is strictly prohibited. Any User found using or attempting to use a non-legitimate copy of the game will have their access to the Server terminated immediately, without the right to appeal.

10. Submission of User-Submitted Content​

By submitting any User-Submitted Content to Hydrate Roleplay, you retain ownership of your content, but you grant Hydrate Roleplay a worldwide, non-exclusive, perpetual, royalty-free, sublicensable licence to use, modify, reproduce, distribute, display, and exploit that content solely for purposes related to the operation, promotion, or improvement of the Services.

You represent that you have the legal right to submit such content and that your submission does not infringe on any third-party rights, including intellectual property rights.

You are solely responsible for ensuring that you have the right to submit the content, and Hydrate Roleplay will not be liable for any claims related to the use of unauthorised or infringing content.

In the event of any third-party claims related to your submitted content, you agree to indemnify and hold Hydrate Roleplay harmless from all damages, costs, and liabilities, including legal fees.

11. Server Data Collection​

By accessing the Server, you acknowledge and agree that all actions and communications within the Server and Services may be monitored, logged, and analysed for the purpose of ensuring compliance with the Community Guidelines, and protecting the integrity of the platform. This includes, but is not limited to, system information, gameplay actions, chat communications, and interactions with other Users or in-game systems.

All monitored or collected data will be used solely for the purposes outlined above or as described in the Privacy Policy. Access to such data is strictly controlled and logged.

12. Disclaimer of Warranties​

The Server and all related Services are provided without any warranties of any kind, express or implied. Hydrate Roleplay disclaims all liability for any loss, damage, or harm resulting from your use of the Server. Hydrate Roleplay disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Your use of the Server is at your own risk.

13. Consumer Law Disclaimer​

Nothing in these Terms of Service is intended to limit or exclude any guarantees, warranties, rights, or remedies that may be provided under the Australian Consumer Law or any other applicable legislation. If any of these Terms of Service are found to contravene applicable laws, including consumer protection laws, those terms will be modified only to the extent necessary to comply with the law, and all other terms will remain in full effect.

These Terms of Service shall be governed by and construed in accordance with the laws of Australia, and any disputes arising from these Terms or the use of the Server will be subject to the exclusive jurisdiction of the courts of Australia.

15. Changes to the Terms of Service​

Hydrate Roleplay reserves the right to modify these Terms of Service at any time. Any changes will be effective immediately upon being posted. It is your responsibility to periodically review these Terms of Service. Continued use of the Services after updates constitutes acceptance of any changes, whether or not you have been notified explicitly.

In the event of significant changes to these Terms of Service, we will notify Users via our official communication channels.

16. Privacy Policy​

By accessing and using the Server, you acknowledge and agree that any personal information collected by Hydrate Roleplay will be handled in accordance with our Privacy Policy. The Privacy Policy outlines how we collect, use, store, and protect your personal data, including system information, and your rights in relation to that data.

The Privacy Policy can be found here. We recommend that you read and understand the Privacy Policy before accessing or using the Server.

By accessing the Hydrate Roleplay Server or Services, you agree to these Terms of Service, Privacy Policy and any applicable Community Guidelines. If you do not agree to these terms, please refrain from using the Services.
